yes, but the concern here is that proprietary vendors usually like applying 
for (and getting) a software patent for thier protocols, and they can then 
use that to bar use of the protocol. in asterisk-speak, g.729 and the intel 
g.729 open sourced implementation is referenced.

however, i do think that it can be included and then when (and IF) a 
cease-and-desist letter comes, we can have it removed.
