 From what I have come to understand :-

The driver code may be GPL, but the hardware it talks to is not.
If that was known, then others could manufacture clone cards.

Some digital cards , on the other hand  that are based on
zapattelephoney.org, are GPL. i.e All info on chips used,
programable registers etc are available.
