How are they not following the rules?  You can fork asterisk if you like.  
It's GPL.  What they are doing is trying to keep the source "clean" in case 
they want to sell it commercially.  I don't disagree with that at all.

If you don't like it, don't contribute.  You don't and you aren't, so the 
system works.

It's not illegal at all.  They are the copyright holder of Asterisk, they can 
do whatever they damn well please without violating the GPL.  I think you 
need to brush up on your understanding of what the GPL does and doesn't do.
