This is not an entirely true statement.  Mark Spencer needs to keep the 
copyrights clean for the Asterisk source tree, so things like G.729 and 
the ability to link to Open H.323 can exist.

Yes, Digium can sell non-gpl licenses to others, but Asterisk has a 
whole is GPL.
