First off, please do realize I am not an attorney and this is NOT
legal advice but some practical experience that I had in my home state
of NJ.
The ideology behind a states sales tax program is that its their bread
and butter, the biggest income generator. Therefore they will enforce
and interpret the law the way they see fit to suit them best, if you
don't like it go and fight city hall. They use you the merchant as the
collection agency for all that and therefore see it as you stealing
their money if you didn't pay it to them.

Now about sales tax on telecommunications (again for NJ to my
knowledge). If the service is delivered to a NJ address (if it's VoIP
then technically it's not) you have to charge sales tax. If the bill
is delivered to a NJ address even if it's VoIP then you have to charge
sales tax. The only exception would be that if it's VoIP and the bill
is delivered to a NJ address but the telecommunications provider is
not registered in state of NJ then you don't have to collect sales
tax. If however its not VoIP (like UNEP etc.) you would have to
register with the state of NJ and collect sales tax.
