Its GPLed they are not allowed under the gpl to make you pay for a
commercial license of GPLed code and still have it GPLed.  They do say
this yes, but they have no legal right under the gpl to enforce it.

Read the gpl it forbids this type of activity.  Read the gpl faq on
gnu.org it also states that its forbidden.  The FSF will not do anything
becuase mysql gives out code, basically their rule for enforcement is
whether or not you give out code.  This selective enforcement is a bad
thing in general terms because selective enforcement leads to weakening
of the overall license but meh.

I believe section 2 of the gpl the very license that mysql is
distributed under (or at least one of the means by which you can obtain
it) states they cant do what they are trying to do.
