Um, no.

Whether has sold anything or not is not a criteria for whether he has 
met the obligations he agreed to.  He has distributed a derivative 
product (the setup executable), and by doing so, has agreed to the terms 
of the GPL.

One of those terms is to produce all the files, original and modified, 
which comprise the source of the binary he distributed.

He has already indicated on the web page that someone will need both the 
original unmodified Asterisk source as well as a set of patches to this 
tree in order to create what he has distributed.
