found the cause of this, its a combination of things, under heavy load when doing a dialplan reload or core reload a few times with the mixture of allot of monitor applications recording calls, this issue happens right away, i've stopped using the monitor application to record calls and now the core reload doesn't cause this issue anymore, thought i let others know incase digium doesn't attempt to fix it
