Here is dialplan copied from extensions.conf.sample:

changed the following line 
if ((inuse <= 1) && (tempchan = ast_request(tech, chan->nativeformats,
number, &status)))
to
if ((inuse > 1) && (tempchan = ast_request(tech, chan->nativeformats,
number, &status)))

seems fixed the problem
