As I see it, big can of worms.......

And VOIP comes in so many different shapes and flavors, this could be a
long drawn out battle to come and many rulings.  

Right now I am under the impression that the verdict was still out on
whether VOIP is a regulated or not service or even if it is
telecommunications. One recent win was the FCC ruling on Free World
Dialup. Understanding of course, that FWD does not charge and to the
best of my knowledge there are no PSTN connections for the average user.
Add PSTN connections and or a charge, well then the verdict may be
different.

Personally I do not think that the FCC is "looking" for "unlicensed"
VOIP carriers (if there is such a thing).  I think it is more the case
that a State (missing out on taxes) and or a "licensed" local carrier
(losing customers, beat up on prices, etc.) raise a red flag to the FCC.
If someone were to become big enough to be noticed, like FWD, then I
would think the funds would be there to fight it or just become
licensed.

The way it looks to me is: Anyone, with the right amount of money and
proper paper work filed can be a common carrier.  So, IMHO the job of
regulators is to make the public think they are doing something on their
behalf when really it's just another form of tax.
